Each summer, as heat indices breach dangerous thresholds across Arizona construction sites and Florida agricultural fields, emergency departments absorb a surge of heat-exhausted workers. Many recover. Some do not. And yet, a striking proportion of these cases vanish entirely from the data streams that public health researchers and federal agencies rely upon to characterize occupational disease burden. The epidemiological record, in this domain, is less a faithful account of reality than a heavily redacted approximation of it.

This is not a peripheral concern. According to the Bureau of Labor Statistics, heat-related fatalities among workers have increased over the past two decades, yet researchers across multiple disciplines have consistently argued that official tallies represent a substantial undercount. The mechanisms driving this undercount are structural, not incidental—embedded in the architecture of American occupational health surveillance itself.

A Patchwork That Cannot Hold

The United States has no unified federal mandate requiring employers to report non-fatal heat illness events to a centralized public health authority. The Occupational Safety and Health Administration (OSHA) collects injury and illness data through its annual employer survey, but heat illness as a discrete category is frequently misclassified under broader diagnostic codes or simply omitted when workers do not seek formal medical attention. States retain wide latitude in determining what, if anything, must be reported—and most have chosen to require very little.

California stands as a partial exception. Following the deaths of several agricultural laborers in the early 2000s, the state enacted mandatory heat illness reporting regulations and implemented a Heat Illness Prevention Standard that has generated one of the more robust subnational datasets in the country. Researchers have leveraged California's data to model exposure-response relationships between ambient temperature and worker morbidity—work that is largely impossible at the national level because comparable data simply does not exist elsewhere.

Texas, Arizona, and Florida—states that combine extreme heat exposure with large populations of outdoor workers in agriculture, construction, and landscaping—operate under far weaker frameworks. In Texas, OSHA enforcement jurisdiction is ceded to the federal program, yet federal OSHA has never promulgated a specific heat illness standard, leaving enforcement to ad hoc general duty clause citations that are notoriously difficult to sustain. The result is a regulatory vacuum in precisely the regions where heat exposure is most acute and most dangerous.

Agriculture's Exemption Problem

The undercount is compounded by longstanding statutory carve-outs that reduce oversight of agricultural employers. Small farms—defined under the Occupational Safety and Health Act as operations employing fewer than eleven workers who have not utilized temporary labor camps—are entirely exempt from OSHA recordkeeping requirements. Given that migrant and seasonal farmworkers are disproportionately employed on such operations, a substantial share of the most heat-vulnerable workers in the country produce no occupational health data whatsoever.

This is not a trivial gap. Epidemiological research has consistently identified farmworkers, particularly Latino and Indigenous workers in the Southeast and Southwest, as bearing a disproportionate burden of heat-related morbidity. Studies drawing on emergency department records, workers' compensation claims, and community health surveys suggest that heat illness rates among agricultural workers may exceed official OSHA estimates by an order of magnitude. Workers who are undocumented face additional barriers to reporting, fearing immigration consequences and employer retaliation—barriers that function as a second layer of surveillance suppression.

The Mortality Misclassification Cascade

Fatal heat illness presents its own epidemiological complications. Death certificates, which form the foundation of occupational mortality surveillance, are completed by physicians and medical examiners who may lack information about decedents' occupational exposures at the time of death. When a 58-year-old construction worker dies of cardiac arrest during a heat event, the death certificate may record cardiovascular disease as the underlying cause without any notation of occupational heat exposure as a contributing factor. This misclassification cascades through vital statistics systems, producing mortality estimates that almost certainly understate heat-attributable occupational deaths.

Researchers at the National Institute for Occupational Safety and Health (NIOSH) have attempted to address this gap through enhanced surveillance projects and retrospective medical examiner record reviews, but these efforts are episodic and resource-dependent. They do not substitute for a systematic, prospective surveillance infrastructure.

Climate Acceleration and the Growing Exposure Frontier

The urgency of this surveillance failure is amplified by the trajectory of climate change. Projections from the National Oceanic and Atmospheric Administration indicate that the frequency, duration, and intensity of extreme heat events will increase substantially across the continental United States through mid-century, with the Southwest and Southeast experiencing some of the most dramatic shifts. The populations most likely to bear the resulting occupational health burden—low-wage outdoor workers, many of them immigrants—are the same populations least likely to appear in existing surveillance systems.

Public health modeling depends on accurate baseline data. Without reliable estimates of current heat illness incidence and mortality, researchers cannot construct credible projections of future burden, cannot evaluate the effectiveness of interventions, and cannot make the evidence-based case for regulatory action that federal rulemaking requires. The surveillance gap is, in this sense, not merely a measurement problem. It is a policy problem that compounds over time as the climate continues to warm.

Toward a Coherent Federal Response

Several pathways toward improved surveillance have been proposed in the academic literature. A federal heat illness prevention standard—long advocated by occupational health researchers and worker advocacy organizations and currently under development at federal OSHA—would establish uniform recordkeeping requirements that could dramatically improve case ascertainment. Integration of heat illness as a mandatory reportable condition in state public health surveillance systems, analogous to infectious disease reporting, has been piloted in a small number of jurisdictions and merits broader adoption.

Enhanced linkage between emergency department data, workers' compensation records, and vital statistics files offers another avenue for improving case identification without requiring new primary reporting infrastructure. The Centers for Disease Control and Prevention's Environmental Public Health Tracking Network has demonstrated that such linkage is technically feasible; scaling it to cover occupational heat illness specifically would represent a meaningful step toward closing the surveillance gap.

What remains absent is the political will to treat occupational heat illness as the public health emergency that epidemiological evidence suggests it already is. In the hottest regions of the country, workers are falling ill and dying at rates the public health system cannot accurately quantify. That invisibility is not an accident of geography or biology. It is a product of deliberate regulatory choices, statutory exemptions, and chronic underinvestment in the surveillance infrastructure that honest epidemiology requires.
